A binding contract between the client and Ontdek Kenya Safaris comes into force only when a non-refundable deposit of 25% of the total cost of the tour has been made for reservations.

The balance is payable 45 days before the departure date. If fully payment is not made by the due date, we reserve the right to treat the booking as having been canceled by you, and apply cancellation charges as set below.


The following cancellation charges will be payable. Should you need to cancel, you must notify Ontdek Kenya Safaris immediately in writing.

Our tour prices as published in our website and brochures are subject to change any time before the acceptance of your booking. The correct current price will be confirmed by email at the time of the booking.


Whilst on safari you are not covered by any insurance. We strongly recommend that you make arrangements so that you and your property are fully insured for the duration of your safari and also for travel in light aircraft and balloons if applicable. Similarly you are advised to arrange adequate insurance in the unforeseen event of any postponement or cancellation of your safari.

We can arrange for you a Flying Doctor's cover for the duration of your stay in Kenya. This covers you for evacuation to a hospital in Nairobi. The costs of emergency treatment and subsequent treatment in hospital are not covered by the Flying Doctor's cover.


1) Though Ontdek Kenya takes all reasonable precautions to make the safaris as safe as possible for travelers, the client must acknowledge that participation on any type of adventure activity involves a certain degree of personal risk.

Although every possible care is taken to safeguard you and your property, we accept no liability to clients for any accidents, injuries, illness or death incurred on any safari outfitted by ourselves, or for any loss or damage to clients' property during such a safari.

Clients should be aware that while on safari with Ontdek Kenya, at times they will be in close proximity to wild animals. A responsible attitude and vigilance is requested when in this situation. Many of the safari camps, lodges and hotels are not fenced. Attacks by animals are rare, however the company cannot guarantee that this may not occur. Ontdek Kenya, it's employees, or its agents can't be held responsible for any injury or incident whatsoever whilst on safari.

2) Ontdek Kenya act only as agents for the client with respect to services provided, included but not limited to, hotels, lodges, camps, restaurants, sightseeing, game drives and all forms of transportation and shall not be liable for injuries, delays, loss or damage of any manner.

3) Ontdek Kenya's liability to passengers carried in its own vehicles is governed by the laws of Kenya and no other country. All claims are subject to the jurisdiction of the courts of the country in which the action arise. The company reserves the right to employ sub-contractors for all or part of the services.

4) We do not accept any liability or pay any compensation in respect to delays or lack of performance affected by 'force majeure'.

Force majeure means any event which the Company has no control over and even in circumstances where all due care was taken the event could not have been avoided or foreseen.

This includes events such as war, or threat of war, riot, civil strife, terrorist activity, industrial dispute, natural disaster, adverse weather conditions, fire and all similar events outside the company's control.


No refund will be payable to the client if he fails to join a tour, or joins a tour after its scheduled departure date or if the client shall leave the tour for any reason. It is the client's responsibility to be at the starting point of the tour at the agreed time. The client will meet any costs (e.g. extra transfers) that may arise from failure to do this.

Alteration to tours

Changes in the safari itineraries may occur, even though all our tours are very carefully planned. We therefore reserve the right to make appropriate changes should conditions demand, both before and after your booking is made.

Most changes will be minor. If we have to make significant changes to an arrangement, you will be notified at the earliest possible opportunity. In such cases you will have the choice of either accepting the change or booking alternative arrangements (paying or receiving a refund in respect of any price difference) or canceling your holiday and receiving an immediate full refund of all monies paid.

The company reserves the right to employ subcontractors for all or part of the services.


It is our aim that you will not encounter any problems during your tour. However, should a problem arise, please advise the tour leader accompanying you or the supplier of the service immediately as most problems can be resolved straight away.

In the event that you remain dissatisfied please write to Ontdek Kenya Ltd detailing the complaint within 25 days of the end of the tour. We regret that we cannot accept any responsibility for any complaints which are not notified to us within this time period.


This contract is constructed under the Kenyan law and it will be governed in accordance with the law of Kenya. Therefore any dispute or matter arising under this contract are subject to the jurisdiction of the Kenyan courts.

By booking and paying a deposit (and thereafter full tour price) of a safari with Ontdek Kenya Safaris, you are deemed to have accepted these liability and insurance clauses outlined above and are also deemed to have understood and accepted all of these booking conditions.
